1. Acceptance of Terms

By using FaxTerra ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FaxTerra provides an online fax sending service. You can upload documents and send them via fax to phone numbers in the United States and Canada.

3. Acceptable Use

You agree not to use FaxTerra to:

• •Send unsolicited faxes (spam) or junk faxes.
• •Send faxes in violation of the Telephone Consumer Protection Act (TCPA) or any other applicable law.
• •Send threatening, harassing, or illegal content.
• •Attempt to circumvent rate limits or abuse the Service.
• •Use the Service for any fraudulent purpose.

4. TCPA Compliance & Per-Fax Attestation

By using FaxTerra, you represent and warrant that you have obtained proper consent from the recipient to send a fax to their number, as required by the Telephone Consumer Protection Act (TCPA). You are solely responsible for ensuring compliance with all applicable telecommunications laws.

Each time you click “Send” on a fax, you are attesting, as of that moment, that you have the recipient's consent to receive the fax and that the content complies with all applicable laws. FaxTerra displays this attestation inline on the send screen. Your click is your legally binding acknowledgment of this representation.

5. Free Tier

FaxTerra offers a limited free tier (2 faxes per day, up to 5 pages each). Free tier availability is subject to change at any time.

6. Payments

Paid faxes are processed through Stripe. All sales are final. If a paid fax fails to deliver due to a FaxTerra error (not a busy or invalid fax number), we will refund the payment.

7. Delivery

FaxTerra will make reasonable efforts to deliver your fax. However, we cannot guarantee delivery, as it depends on the recipient's fax machine being operational and answering the call. We are not responsible for failed deliveries due to busy signals, invalid numbers, or recipient equipment issues.

8. Privacy

Your use of FaxTerra is also governed by our Privacy Policy.

9. Limitation of Liability

FaxTerra is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the specific fax transaction in question.

10. Termination

We reserve the right to suspend or terminate your access to FaxTerra at any time, with or without cause, including for violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
